Clear wrap used to stop trespassers
Ya'll know we shouldn't trespass. Now, for those that haven't heard, land owners are using clear wrap instead of the old wire/chain links across their properties gig to stop trespassers. Maybe they think it won't kill/maim those ones that trespass using clear wrap thinking it'll maybe act like a catch fence.
We got plenty of places to MX and ride other disciplines, so be careful, and don't trespass for your own safety. If this has been mentioned in the past, sorry for the repeat.

Good post; however, NO MATTER what the reason...when someone goes out of there way to cause bodily harm or injury...THEY are goin' to Jail.
Period.

FYI: as a property owner, I will tell you that about a month ago a guy was riding where he shouldn't have been and we finally put a fence up....he ran into it and broke his hand in 6 places.
We aren't being sued and WE told the sheriff we didn't want to press trespassing charges OR to charge him for property damage (he totalled our gate.)
Don't think you can trespass, damage property AND get away with it (much less sue the property owner.) That is NOT usually the case.
Ride safe.....ride legal!

Trust me, I'm on YOUR side of this issue; however, Intentional Bodily harm isn't justified here.
I don't like the NEGATIVE impact these idiots have on my sport and recreation.
On the other-hand: I don't like seeing people taking each-others well being for granted.
Talk about a situation where,"Two wrongs don't make a Right!"
BTW, putting a fence up is COMPLETELY LEGITIMATE and I don't have ANY intention of comparing it to the folks that actually try to harm/kill people with "Clotheslining".

You are totally correct....anyone who puts up a barrier with the INTENTION of causing harm is totally in the wrong. We specifically did NOT finish fencing our property because we were worried about riders getting hurt. BUT....someone who puts up clear plastic cause that is all that they can afford and who says they did it cause they thought it WOULDN'T cause harm is NOT going to get sued and lose.
There is all this hype out there about all the money that people get filing these crazy lawsuites and it just ISN'T true. Just like the case about the woman who got burned with the McDonalds's coffee...remember that? Most people don't even know the TRUE legal case and how it all went down. Lots of people have really LEGITIMATE cases that don't ever see a dime.
Just BE CAREFUL......you don't want to get hurt AND get screwed.

As a lawyer, I disgagree with your former comment, and agree with the latter. Namely, if a land owner puts up some kind of property barrier which is "objectively foreseeable" (key legal term) to a reasonable person that it could cause harm to a tresspasser, then that property owner CAN be held liable. It is no defense that they didn't subjectively know that it was potentially dangerous.
As for media stories about large settlements, some are true, some are BS. As for the Wack D's case, there was a very large damage award by the jury, which was later reduced on remittitur (an agreement by the plaintiff to take lesser money if the defense won't appeal further).

Yea we had some douche bag trail riders riding next to my track (without permission) on cattle grazing property get my track shut down. I had permission to go through the cattle property as long as I stayed on 1 path but thanks to these fags I do not have access to my track anymore. So people that do stupid things like described above deserve bodily injury.
