Greetings Senator,

I am asking of you to Co-Sponsor and Support S. 616, "The HIPAA Recreational Injury Technical Correction Act."

S. 616 aims at ending Health Care Discrimination for individuals participating in legal Transportation and Recreational Activities-Activities like Motorcycling, Snowmobiling, Skiing, Horseback Riding, and All-Terrain Vehicle Riding. This Legislation addresses a loophole caused by a Department of Health and Human Services' rule making it possible for health care benefits to be denied to those who are injured while participating in these activities.

U.S. Senator Russ Feingold (D-WI) noted; "People participating in activities like Motorcycling, Skiing, Snowmobiling and other Outdoor Activities should not be put at risk because of this Health Insurance loophole. This Bipartisan Legislation will offer Outdoor Recreation lovers the protection they deserve,"

On August 21, 1996 an important opportunity arose when President Clinton signed the Health Insurance Portability and Accountability Act (HIPAA), prohibiting employers from denying Health Care coverage based on a worker’s pre-existing medical conditions or participation in legal activities, such as Motorcycling.

In 2001, the Department of Health and Human Services released the final rules that would Govern the HIPAA law. The rules recognize that employers cannot refuse Health Care coverage to an employee on the basis of their participation in a recognized Legal activity. However, the benefits can be denied for injuries sustained in connection with those activities. Therefore, you were guaranteed the right to Health Care coverage but not guaranteed any benefits in return for your monthly payments.

In the last 2 years, the “Off-Road Vehicle” , “ATV” sales and riders have tripled. Living in the State of Nevada we are almost able to ride out our back yard and into the Open Land, Riding Trails and enjoying the Open Space as a Recreational Sport. The amount of participants in the Racing world have more than doubled also in the last 2 years such as MotoCross and Desert Racing. Some feel that Racing is dangerous, when honestly it is safe; a Race is in a Controlled Atmosphere as there are Groomed and Watered Tracks, Emergency Medical Technicians and trained Flaggers on the track to warn the Riders of a potential threat. You are also required to wear safety gear such as Helmets, Chest Protectors, Pants, Shirts, Gloves and Riding Boots that are geared towards safety for the Rider. The Motorcycles are regulated as to the size of the bikes and the experience of the Rider.

I am begging of you to take initiative to make sure S. 616, "The HIPAA Recreational Injury Technical Correction Act." is supported. Too many Insurance Companies come up with a “Generic Exemption” page that they are able to turn and tweak to benefit no one but them selves. This leaving the Patient, the Family, Friends, Doctors, Emergency Personnel and Hospitals in a frenzied rush to get Medical Attention and payment for these services.

We need to support and rally S. 616, "The HIPAA Recreational Injury Technical Correction Act." in doing this we not only protect our Citizens of the United States who invest in Health Insurance Programs, but this would also help in declining the amount of people having to turn to SSI, DISABILITY, WELFARE, FOOD STAMPS, COUNTY HEALTH and more than likely MEDICAL BANKRUPTCY. Make the Health Insurance Company(s) responsible for their actions, make it harder for them to Deny any/and all claims made for injuries while enjoying the great outdoors of Nevada. By doing this it will definitely benefit the Health Care Crisis in this awesome Country of ours. Please take the time to investigate for yourself and support S. 616, "The HIPAA Recreational Injury Technical Correction Act".

Done!! By the way I have had to fight this with in my own company...My bill was 800,000 $ and they did not want to pay for exactly the reasons stated...I argued with them that no kid getting hurt playing football, soccer,tennis,etc then will be covered...How about riding a bicycle and you get hit by a car etc...They finally gave in,,but they want this type of legislation badly so they can have loophole after loophole....This would put Motocrossers out of business very fast,,,please send this to these two dumb ass senators and hopefully for once they listen to the folks!!

I would rather not say on a public forum,,I worked for them for 17 years and no longer do, but I am in the same industry as they are and dont want to burn any bridges,,they might be a customer one day ya know...If I ever see ya in person I will tell you...See ya

Of course my injuries where always related to "Trail" riding, never racing or on a practice track to avoid the hassle.

Mike that is a good point...That is what I had stated also to give it a Hobby feel vs "RACIN", "MOTOCROSS", such BS isnt it?

I have never been hurt riding a motorcycle.

THat is why I never take an ambulance from the track.
